After several mails, and ph calls to me............hey russ, check out that "new" gyro site...........i did

Well bugger me.........the infamous "tosser" from the asra site has cranked up his own site and there i am ..........and you lot..........we is all there.

All our postings ........the lot, over all those years.

he's got the hide to not only list us all as "his members" he also indicates by good choosing of words that his site is "the MAIN gyro site in oz"

So..........."asra"...........wot's the go here, the transfering of the asra contents by this tosser puzzles me some what........surely it's questionable.....dare i say "th.ft"

BAZA...........mate.......delete me name off your members list.......it's a bleedin insult to me..........ya dickhead :Bat1:

You put your posts on the then 'ASRA' site under the understanding that it was at the time an 'ASRA' site, there and paid for by the members of ASRA, including you, you contributed on that basis, but that base has been breached, so you have been deceived by the person who induced you to think that the site at the time was an 'ASRA' site. Just to rub salt into the wounds, you paid for that site via your ASRA fees, these have now been abused to the extent that your postings have turned up on a site through the misappropriation of Data which you considered or were given the impression belonged to ASRA, the removal or use of same without your permission constitutes a benefit to another party gained through a deception, which is a fraudulent practice.

You have copyright over all your intellectual property, and this extends to postings on the 'ASRA' site which you posted under certain assumptions and conditions, so if anyone were to use your material without your permission, express, implied , written or otherwise, they would be breaching your copyright, ie, your postings have been copied without your permission - you didn't consent to it did you?. A breach of copyright for a commercial benefit [Advertising Horth Motors and selling them for profit] could be construed as an impingement on a couple of your rights, 1 - the income stream flowing from same that should be yours because you expressed an opinion about the said engines and people chose to buy same due to your opinions, ie, you spent your time and effort promoting a product and you didn't get paid for it - though you considered you should be paid for same, and, 2 - the association between yourself, the engines and their vendor has been compromised - you may dislike being associated with Horth Engines as you may not like them, for what ever reasons you have, or, conversely you may like them, but may not like to be associated with their vendor, but if it is portrayed as anything other than how you wish to have it portrayed, that might be a defamation.. so the webmaster may have some problems with you...

You could ask nicely and send a polite request for the display of your intellectual property to be removed as I did - I personally sent an email to the webmaster in question and asked him to delete all my intellectual property from his site, and checked that he did - so if you find one of my posts there he is in trouble with me for same.

Failing that you could begin legal procedures against the culprit and make it completely not worth his while to carry your IP on his site, like I said I would do.
